On June 28, 2006, a summary of facts in the case so far was filed by prosecutors in Spokane, detailing why authorities were justified at the time in filing the stolen property charge against Kevin Newland.

According to the summary, the Spokane County Sheriff's Office was first made aware of Jamie Lynn Drake's disappearance on June 24th, when her sister called them, worried that she'd not heard from Jamie and been unable to reach her.
