DA Hesitant to File Charges Against James Koepp in Lentz Homicides

Koepp has been in the Rock County Jail since January 13, 2006, held on $60,000 bond for charges of DWI, eluding a police officer, and reckless driving.  On February 22, Koepp's attorney, Assistant Public Defender Larry Peterson, filed a motion to reduce his client's bond. 

According to Peterson, Koepp's bond was set high because the court had expected his client to be charged with three counts of first-degree intentional homicide.  Those charges never came, and now Peterson says his client should have a lowered bond, possibly a recognizance bond, which, if the judge approves, would allow his client to be freed until his trial.

Spoden is not convinced that Koepp will not try to leave the area and has said that if Koepp makes bail, his deputies will keep him on 24-hour surveillance.

The sheriff's department expects to wrap the case up as soon as they receive the DNA test results from the Wisconsin State Crime Lab.  All together, 49 pieces of evidence were sent to the lab, along with 30 DNA samples that were voluntarily collected from anyone who had reason to be in the Lentz home prior to the triple homicide.
