According to Russell, loitering for the purpose of prostitution is a violation as a first offense in Kentucky and a class B misdemeanor for subsequent offenses. Since it was Schum's first offense, he was cited, rather than arrested.

"You can take them to jail if you feel that person is not going to show up for court, but, typically, that is rare to do, so he was cited," Russell said, adding, "There is no mug shot or anything like that."

WHAS11.com recently obtained a raw copy of the dash cam video of Schum's citation, which is available at the following link.

On November 27, 2007, Schum's attorney entered a not guilty plea on behalf of his client in a Jefferson County courtroom. Schum is expected to make his own appearance in court sometime later this month.
