Prosecutors insist federal law applies
Prosecutors, in their recommendations to the judge, have asked that jurors be instructed that federal law would apply to Rodriguez regardless, as long as Dru was alive when she was taken from the North Dakota mall where she was last seen alive on Nov. 22, 2003.
"The transportation of the victim began when she was willfully moved any distance whatsoever from the precise point of her abduction," the prosecution's proposed instructions read. "The United States need not prove that the defendant knew he was crossing a state line with the victim or the victim's body."

The trial is adjourned until Monday, when the prosecution is expected to wrap up its case.
