When a deputy placed the women in the patrol car, they both allegedly attempted to bite him and one of them flashed her breasts at him. Neither of the women had any bite marks on their bodies when they were placed in the patrol car. However, somewhere along the way to the Seminole County Jail, Hernandez bit Jimenez's arm, resulting in minor injuries.

"Because of this entire situation, they face a variety of different charges," Lemma said. "The first is battery on the Vice President of the Association; the second would be resisting a law enforcement officer's arrest with violence. They also face charges of false imprisonment for not allowing people to exit the gate from the pool area, indecent exposure, and lewd and lascivious behavior for engaging in [oral sex] in the presence of that eight-year-old child. The second woman, who came to the aide of her friend, was also charged with resisting arrest and battery on a law enforcement officer."
According to a report by news station WESH, Hernandez denies she was having sex with Jimenez, and claims she was merely showing off her new breast implants when someone walked in. She offered no explanation for the alleged photographs.
