A Distinction Between Law and Morality

Under the law in Pennsylvania , Kara's silence does not make her culpable,
Totaro said. The "Pennsylvania legislature has distinguished between a legal
duty to act and a moral duty to act," Totaro wrote. "Based upon the known
facts and applicable Pennsylvania law, Kara Borden is not legally chargeable
as an accomplice or conspirator to David Ludwig."

"Finally, there is not any visible evidence to show that after the killings,
Kara Borden concealed Ludwig, provided him with aid or assisted him in
destroying evidence," Totaro wrote. "Accordingly, she cannot be charged with
hindering his apprehension."

Authorities have said that Ludwig killed the Bordens after he and Kara had
spent the night together and her parents confronted them. After a 30-minute
conversation, Ludwig, who had concealed a Glock pistol in the waist band of
his pants, shot and killed Michael Borden, then turned to Catherine, gunning
down the woman as she rose from a chair in the living room.

Kara, authorities said, fled when she heard the shooting, and witnesses told
authorities that they heard Ludwig call out to her, "Kara, come out, I'm not
going to hurt you."

A neighbor, driving nearby at the time told investigators that he saw Kara
running down the street, her face blanched and panicked "like she had seen a
ghost."

Moments later, Kara voluntarily hopped into Ludwig's Volkswagen Jetta and
the two fled west. The following day, Ludwig was arrested - with Kara beside
him - when he crashed his car into a tree ending a high-speed pursuit by
police in Indiana .
