Richmond, Va. (Crime Library) — Continued

George Peterson, attorney for Taylor Behl's mother, Janet Pelasara, spoke to the executive editor for Court TV's crimelibrary.com, Marilyn Bardsley, about some of the details of this case, as well as possible future developments.

Some questions being asked about Taylor's disappearance and death have yet to be answered, or still cannot be answered publicly for instance, it is still unclear as to what happened to some of Taylor Behl's personal effects her cellphone, student ID, and car keys. Ben Fawley would have been the last person to have these items. Fawley admitted on October 12 to Richmond authorities that he was with Taylor the night she died, claiming she died during "rough sex." He said he disposed of her body, wrapped in plastic, in a ravine in Mathews County, VA that same night. Additionally, though it is known that Taylor made a cellphone call to a male around 9:30 the night she disappeared, Peterson was unable to name the man or give any further details as to the nature of the call.

Did Ben Fawley perhaps dispose of or hide Taylor Behl's cellphone, identification, and car keys once he was back in Richmond? Or did he dispose of them randomly along the route from Mathews County that night?

George Peterson was able to make more specific statements about what may happen next in the investigation. He stated that he expected Fawley may be indicted in Mathews County in about 3 weeks. Virginia law states that if evidence cannot be found to pinpoint an original crime scene, then the county where a homicide victim's remains were found will have jurisdiction over the trial.

According to George Peterson, it is likely that Ben Fawley will be indicted for capital murder.

This possibility refutes Ben Fawley's story of a mutual encounter that went terribly wrong. Peterson said that any sex that night between Behl and Fawley was not consensual, and she rejected his advances. Peterson did not give details, but Taylor Behl may have told friends that she and Fawley were not on intimate terms after April. Peterson said she was raped and murdered, which constitutes the special case for felony murder, a capital case in VA.
