Koepp has a previous criminal record and is listed on the Wisconsin Department of Corrections Sex Offender Registry. According to thewebsite, he was convicted of four counts of second-degree sexual assault in 1984, for which he was sentenced to 10 years in prison.
Online court records indicate he appealed the conviction in 1986. Those same documents also describe the incidents that resulted in his arrest.

"James Koepp appeals his convictions for four counts of second-degree sexual assault under sec. 940.225(2)(a), Stats. There were two victims to the assaults. Koepp received 5- and 10-year concurrent sentences on two counts and concurrent 10-year sentences on two counts...
"The assailant sexually assaulted the two victims in their bedrooms in an alcohol abuse rehabilitation center. The assault occurred in the middle of the night. Identification was the issue at trial. Before the incident, Koepp had at one time been a resident of the center...during the trial, Koepp maintained that he suffered from 'alcoholic blackout' and could not remember where he was at the time of the incident."
In his appeal, Koepp argued, among other things, that the victims misidentified him and that there were discrepancies in their testimony. Nonetheless, his appeal was denied and the court affirmed the judgment.
